
Video License Agreement
PLEASE READ THIS AGREEMENT AND LICENSE CAREFULLY BEFORE COMPLETING YOUR PURCHASE.
Metalcraft Tools, Metalcraft Tools Skill Center, and Joyce L. Davis (Metalcraft Tools) grant to the Customer a non-exclusive and non-transferable license to view the Video on a single computer for a maximum of five viewings. After five viewings, the Video will not be viewable.
The Customer agrees not to transfer, sub-license, copy, reproduce, distribute, post, upload, broadcast, transmit, sell, rent, or give away copies or access to the Video or portions thereof, whether video, stills, or screen shots. The Customer agrees not to conduct public viewings of the Video or to otherwise allow viewing of the Video or portions thereof by anyone who has not obtained a License for the Video from Metalcraft Tools. The Customer agrees not to modify or change the presentation format embodied in the Video.
The Video is intended to provide reasonably accurate and authoritative information in regard to the subject matter covered. Because it is impossible to guarantee the total and absolute accuracy of the material and techniques contained in the Video, Metalcraft Tools cannot and does not assume any responsibility for omissions, errors, misrepresentations, or ambiguity contained in the Video.
The Video is provided 'AS IS' without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Metalcraft Tools does not warrant or make any representations regarding the use, suitability, or results of the use of any information and techniques contained in the Video. Neither does Metalcraft Tools warrant or make any representations regarding the accuracy, adequacy, completeness, legality, reliability, or usefulness of any information and/or techniques contained in the Video.
In no event will Metalcraft Tools be liable for any lost revenue, profit, or data, or for special, indirect, consequential, incidental, or punitive damages however caused and regardless of the theory of liability arising out of the use of or inability to view the Video even if Metalcraft Tools has been advised of the possibility of such damages.
This Agreement and License shall be governed by and construed in accordance with the laws of the State of Tennessee, United States of America. If any portion of this Agreement and License is found to be void or unenforceable, the remaining portions shall remain in full effect and force. This Agreement and License constitutes the entire Agreement and License between the parties with respect to use of the Video.
